How Long Do I Have to File an Auto Accident Claim in South Carolina?
Per South Carolina Code § 15-3-530, people usually have three years from the date of an auto accident to file a personal injury or wrongful death claim. After that three-year statute of limitations has expired, you can’t take legal action for a crash.

Can I Still File an Auto Accident Lawsuit If I Am Partially at Fault?

For example, if you were 25% at fault in an auto accident and the jury awarded you $100,000, you would then receive $75,000 in damages.
